These terms of service constitute a legally binding agreement (the “Agreement”) between you and FOSTERING MOBILITY, S.L. (“Meep”, “Meep.app”, “we,” “us” or “our”) governing your use of the Meep application, website, and technology platform (collectively, the “Meep Platform”).
PLEASE BE ADVISED: THIS AGREEMENT CONTAINS PROVISIONS THAT GOVERN HOW CLAIMS YOU AND MEEP HAVE AGAINST EACH OTHER CAN BE BROUGHT (SEE SECTION “DISPUTE RESOLUTION”). THESE PROVISIONS WILL, WITH LIMITED EXCEPTION, REQUIRE YOU TO SUBMIT CLAIMS YOU HAVE AGAINST MEEP AS A PLAINTIFF IN ACCORDANCE WITH SPANISH LAW.
By entering into to this Agreement, you expressly acknowledge that you understand this Agreement (including the dispute resolution) and accept all of its terms. IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT, YOU MAY NOT USE OR ACCESS THE MEEP PLATFORM.
“Meep”, “Meep.app”, “us”, “we” or “our” means FOSTERING MOBILITY, S.L. a limited liability company incorporated under the laws of the Spain, and having its registered address at Paseo de la Habana 26, 1º-2 28036 Madrid.
“The Meep Platform” means the (mobile) website and app on which the mobility services are made available owned, controlled, managed, maintained and/or hosted by Meep. The Meep Platform provides a marketplace where individuals who seek transportation are matched with Operators that are providing those services at the same time. The individuals are referred a “Users” and each User shall create a User account that enables access to the Meep Platform. For purposes of this Agreement, the mobility services provided by Operators to Users that are matched through the Platform shall be referred to collectively as the “Services”. Any decision by a User to offer or accept Services is a decision made in such User’s sole discretion. Each transportation Service provided by the Operator to a User shall constitute a separate agreement between such persons.
“Journey” means the various different transportation services that can be ordered, acquired, purchased, bought, paid, rented, provided, reserved, combined or consummated by you from the Journey Provider.
“Journey Provider”, “Operator” means the professional provider of transportation (e.g. car rentals, car parkings, e-hailing services, on-demand services, vehicle sharing, buses, cruises, rail, airport rides, coach tours, transfers) available for Journey Reservation on the Platform (whether B2B or B2C).
“Journey Service” means the online purchase, order, (facilitated) payment or reservation service as offered or enabled by Meep in respect of various products and services as from time to time made available by Journey Providers on the Platform.
“Journey Reservation” means the order, purchase, payment, booking or reservation of a Journey.
Scope and nature of our Service
Through the Meep Platform, we (FOSTERING MOBILITY, S.L. and its partners) provide an online platform through which Journey Providers – in their professional conduct of business (i.e. B2C or B2B) – can advertise, market, sell, promote and/or offer (as applicable) their products and service for order, purchase, reservation, hire, and through which relevant visitors of the Platform can discover, search, compare, and make an order, reservation, purchase or payment (i.e. the Journey Service). By using the Journey Service (e.g. by making a Journey Reservation through the Journey Service), you enter into a direct (legally binding) contractual relationship with the Operator with which you make a reservation or purchase a product or service (as applicable). From the point at which you make your Journey Reservation, we act solely as an intermediary between you and the Operator, transmitting the relevant details of your Journey Reservation to the relevant Operator(s) and sending you a confirmation email for and on behalf of the Operator. Meep does not (re)sell, rent out, offer any (travel) product or service.
When rendering our Journey Service, the information that we disclose is based on the information provided to us by Operators. As such, the Operators that market and promote their Journey on the Platform are given access to our systems through which they are fully responsible for updating all fares, availability, policies & conditions and other relevant information which is displayed on the Meep Platform. Although we will apply reasonable skill and care in performing our Journey Service, we cannot guarantee that all information is accurate, complete or correct; nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any temporary and/or partial breakdown, repair, upgrade or maintenance of the Meep Platform or otherwise), inaccurate, misleading or untrue information or non-delivery of information. Each Operator remains responsible at all times for the accuracy, completeness and correctness of the provided information (including the fares, policies & conditions and availability) displayed on the Meep Platform. The Meep Platform does not constitute a recommendation or endorsement of the quality, service level, qualification or rating of any Operator (or its facilities, venue, vehicles, (main or ancillary) products or services) made available.
Our Journey Service is made available for personal and non-commercial use only. Therefore, you are not allowed to re-sell, deep-link, use, copy, monitor (e.g. spider, scrape), display, download or reproduce any content or information, software, reservations, tickets, products or services available on the Meep Platform for any commercial or competitive activity or purpose.
Prices, Variable Prices and Quoted Prices
The prices as offered by the Operators on the Meep Platform are very competitive. All prices for your Journey are displayed including VAT/sales tax and all other taxes (subject to change of such taxes) and fees, unless stated differently on the Meep Platform or the confirmation email/ticket. Ticket prices are per person or group and subject to validity or expiration as indicated on the ticket, if applicable. Applicable fees and taxes (including tourist/city tax) may be charged by the Operator in the event of a no-show, rebooking or cancellation.
Variable Prices consist of a base charge and incremental charges based on the duration and distance of your journey. For particularly short journeys, minimum fares may apply. Please note that we use GPS data from Operator’s phone to calculate the distance traveled on your ride. We cannot guarantee the availability or accuracy of GPS data. If we lose signal we will calculate time and distance using available data from your journey.
Quoted Prices. In some cases, Meep may quote you a price at the time of your request. The quote is subject to change until the journey request is confirmed. If during your journey you change your destination, make multiple stops, or attempt to abuse the Meep Platform, we may cancel the price quote and charge you a variable price based on the time and distance of your journey. Meep does not guarantee that the quoted price will be equal to a variable price for the same journey.
The fixed prices are those given at the time of making the request or reservation. These will depend on the rate set by the operator.
Fees and Other Charges
Service Fee. Meep may assess a per-journey “Service Fee” to support the Meep Platform and related services provided to you by Meep. The amount of the Service Fee may vary but shall be retained by Meep in its entirety.
Cancellation Fee. After requesting a journey, you may cancel it through the app, but note that in certain cases a cancellation fee may apply. You may also be charged if you fail to show up after requesting a journey. Please check out our Help Center to learn more about Meep’s cancellation policy, including applicable fees. Collected cancellation fees will be passed in their entirety to the Operator who had accepted your journey request.
Damage Fee. If an Operator reports that you have materially damaged the Operator’s vehicle or property, you agree to pay a “Damage Fee” of up to 500€ depending on the extent of the damage (as determined by Meep in its sole discretion), towards vehicle repair or cleaning. Meep reserves the right (but is not obligated) to verify or otherwise require documentation of damages prior to processing the Damage Fee. Collected Damage Fees will be passed in their entirety to the Operator whose vehicle or property was damaged.
Tolls. In some instances, tolls (or return tolls) may apply to your journey. Please see our Help Desk and your market’s Meep Cities page for more information about toll charges and a list of applicable tolls and return charges. We do not guarantee that the amount charged by Meep will match the toll charged to the Operator, if any. The amount of collected tolls (and return tolls) will be passed in their entirety to the Operator who provided your journey.
Other Charges and surcharges may apply to your ride, including: actual or anticipated airport fees, state or local fees, event fees as determined by Meep or its marketing partners, and processing fees for split payments. In addition, where required by law Meep will collect applicable taxes. These other charges are not shared with the Operator unless expressly stated otherwise. See your market’s Meep Cities page for details on other Charges that may apply to your journey.
Tips. Following a journey, you may elect to tip Operator’s driver in cash or through the Meep application. Any tips will be provided entirely to the applicable Driver.
Facilitation of Charges. All Charges are facilitated through a third-party payment processing service (e.g., Alert or PayPal, Inc.). Meep may replace its third-party payment processing services without notice to you. Charges shall only be made through the Meep Platform. With the exception of tips, cash payments are strictly prohibited.
No Refunds. All Charges are non-refundable. This no-refund policy shall apply at all times regardless of your decision to terminate usage of the Meep Platform, any disruption to the Meep Platform or Services, or any other reason whatsoever.
Discounts only apply to the Price, not the Service Fee or other charges. If you split payment for a Journey with another User, your Meep Points or Special Discount will only apply to your portion of the total Price. Additional restrictions on Meep Points and Special Discounts may apply as communicated to you in a relevant promotion or by clicking on the relevant Meep Points and Special Discounts within the Method of Payment section of the Meep App.
Credit Card Authorization and Method of Payment
Credit Card Authorization. Upon addition of a new payment method or each journey request, Meep may seek authorization of your selected payment method to verify the payment method, ensure the journey cost will be covered, and protect against unauthorized behavior. The authorization is not a charge; however, it may reduce your available credit by the authorization amount until your bank’s next processing cycle. Should the amount of our authorization exceed the total funds on deposit in your account, you may be subject to non-sufficient funds charges by the bank issuing your debit or check card. We cannot be held responsible for these charges and are unable to assist you in recovering them from your issuing bank. Check out our Help Desk to learn more about our use of pre-authorization holds.
Specifications per country
When Meep user adds a new card, we immediately charge one euro to verify the identity and veracity of the card and once verified, we repaid the euro in the user account.

Payments, Pre-payment, Cancellation, No Show Policy
Meep will process all payments due to you through its third-party payments processor. You acknowledge and agree that such amounts shall not include any interest and will be net of any amounts that we are required to withhold by law. The Payment is safely processed from your credit/debit card or bank account to the bank account of the accommodation provider through a third-party payment processor. Any payment facilitated by us for and on behalf of, and transferred to the Operator will in each case constitute a payment of the booking price by you of the relevant product or service in final settlement of such due and payable price and you cannot reclaim such paid quantities.
By making a Journey Reservation with an Operator, you accept and agree to the relevant cancellation and no-show policy of that Operator, and to any additional (delivery) terms and conditions of the Operator that may apply to your journey, including for services rendered and/or products offered by the Operator. The relevant (delivery/purchase/use/carrier) terms and conditions of an Operator can be obtained with the relevant Operator. The general cancellation and no-show policy of each Operator is made available on the Meep Platform on the Operator information pages, during the reservation procedure and in the confirmation email or ticket (if applicable). Please note that certain rates, fees or special offers are not eligible for cancellation, refund or change. Applicable city/tourist tax may still be charged by the Operator in the event of a no-show or charged cancellation. Please check the reservation details of your product or service of choice thoroughly for any such conditions prior to making your reservation. Please note that a Journey Reservation which requires down payment or, wholly or partly, prepayment may be cancelled (without a prior notice of default or warning) insofar the remaining amount(s) cannot be collected in full on the relevant due or payment date in accordance with the relevant payment policy of the Operator and the reservation.
Pre-payment and Cancellation policies may vary per segment, product or service of each journey. Please carefully read the fine print (below the Journey types or at the bottom of each Operator’s page on th Meep Platform) and important information in your reservation confirmation for additional policies as may be applied by the Operator (e.g. in respect of age requirement, security deposit, non-cancellation/additional supplements for group bookings, additional booking time). Late payment, wrong bank, debit or credit card details, invalid credit/debit cards or insufficient funds are for your own risk and account and you shall not be entitled to any refund of any (non-refundable) prepaid amount unless the Operator agrees or allows otherwise under its (pre)payment and cancellation policy.
If you wish to review, adjust or cancel your reservation, please follow the instructions in the Meep Platform. Please note that you may be charged for your cancellation in accordance with the Operator’s cancellation, (pre)payment and no-show policy or not be entitled to any repayment of any (pre)paid amount. We recommend that you read the cancellation, (pre)payment and no-show policy of the Operator carefully prior to making your reservation and remember to make further payments on time as may be required for the relevant reservation.
If you have a late or delayed arrival on the mode of transportation or service, make sure to follow the rebooking instructions in the Meep Platform if there is a possibility or otherwise, cancel following the instructions provided in the Meep Platform. Our Help Desk can help you if needed more information. Meep does not accept any liability or responsibility for the consequences of your delayed arrival or any cancellation or charged no-show fee by the Operator.
Information We Collect
Personal Information You Give to Us
Registration Information. When you sign up for a Meep account, you give us your name, email, gender, date of birth and phone number. If you decide to sign up for Meep using your Facebook account, we will also get basic information from your Facebook profile like your name, gender, profile photo, and Facebook friends.
User Profile Information. When you join the Meep Platform, you can create a Meep Profile to share facts about yourself, and discover mutual friends and interests. Filling out a profile is optional, and you can share as much as you want. Your name is always part of your Profile. You can also add a Business Profile to your account, which requires a designated business email address and method of payment.
Payment Method. When you add a credit card or payment method to your Meep account, a third-party that handles payments for us will receive your card information. To keep your financial data secure, we do not store your credit card information on our servers.
Communications. If you contact us directly, we may receive additional information about you. We may use automated systems to review communications for security purposes; fraud prevention; compliance with legal and regulatory requirements; investigations of potential misconduct; product development and improvement; research; customer engagement, including to provide you with information and offers that we believe may be of interest to you; and customer or technical support. We reserve the right to block the delivery of communications that we believe may contain malicious content. You may participate in referral programs you may need to provide us with personal information.
Personal Information We Collect When You Use the Meep Platform
Location Information. Meep is all about improving your mobility. To do this, we need to know where you are. When you open Meep on your mobile device, we receive your location. We may also collect the precise location of your device when the app is running in the foreground or background. If you record certain frequent locations, such as “home” and “work,” we receive that information, too.
Your location information is necessary for providing the best transportation options, determining drop off and pick up locations, and suggesting best route options based on previous journeys. Also, if the need ever arises, our team may use and share location information to help protect the safety of Meep Users or a member of the public. In addition to the reasons described above, Operators’ location information and distance travelled is necessary for calculating prices. If you give us permission through your device settings or Meep app, we may collect your location while the app is off to identify promotions or service updates in your area.
Device Information. Meep receives information from Users’ devices, including IP address, web browser type, mobile operating system version, phone carrier and manufacturer, application installations, device identifiers, mobile advertising identifiers, push notification tokens, and, if you register with your Facebook account, your Facebook identifier. We collect mobile sensor data from Operators’ devices (such as speed, direction, height, acceleration or deceleration) to improve location accuracy and analyze usage patterns.
Usage Information. To help us understand how you use the Meep Platform and to help us improve it, we automatically receive information about your interactions with the Meep Platform, like the pages or other content you view, your actions within the Meep app, and the dates and times of your visits.
Call and Text Information. We work with a third-party partner to facilitate phone calls and text messages between Operators and End Users who have been connected for a journey. We receive information about these communications including the date and time of the call or SMS message, the parties’ phone numbers, and the content of any SMS messages. For security purposes, we may also monitor the contents of phone calls made on the Meep Platform, such as those between Operators and End Users. You will be given notice that your call may be recorded, and by proceeding you agree to allow Meep to monitor and/or record your call.
User Feedback. At Meep, we want to make sure that we provide the best mobility services to the Users. Operators and Users may rate and review each other at the end of every journey. We receive information about ratings and reviews.
Information from Cookies and Similar Technologies. We collect information through the use of “cookies”, tracking pixels, and similar technologies to understand how you navigate through the Meep Platform and interact with advertisements, to learn what content is popular, and to save your preferences. Cookies are small text files that web servers place on your device; they are designed to store basic information and to help websites and apps recognize your browser. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be accessed every time you use the Meep Platform. You should consult your web browser(s) to modify your cookie settings. Please note that if you delete or choose not to accept cookies from us, you may be missing out on certain features of the Meep Platform.

Personal Information We Collect from Third Parties
Third Party Services. If you choose to register for Meep or otherwise link your Meep account with a third party’s service (such as Facebook, Twitter or Google+), we may receive the same type of information we collect from you directly from those services.
Third-Party Partners. We may receive additional information about you, such as demographic data, payment information, or fraud detection information, from third-party partners or Operators and combine it with other information that we have about you.
Enterprise Accounts. If your company, university, or organization participates in one of our enterprise programs such as Meep for Companies, we may receive information about you, such as your email address, from your participating organization. We also may give your participating organization the opportunity to request a journey on your behalf, in which case they may provide us with your name, phone number, and the starting and ending location for your journey.
How We Use the Information We Collect
We use the information we collect from all Users to:
• Enhance your mobility experience;
• Connect Users with Mobility Providers;
• Provide, improve, expand, and promote the Meep Platform;
• Analyze how users uses the Meep Platform;
• Communicate with you, either directly or through one of our partners, including for marketing and promotional purposes;
• Personalize the Meep experience for you and your friends and contacts;
• Send you text messages and push notifications;
• Facilitate transactions and payments;
• Provide you with customer support;
• Find and prevent fraud; and
• Respond to trust and safety issues that may arise, including auto incidents, disputes between Users and Operators, and requests from government authorities.
How We Share the Information We Collect
In certain circumstances, we’ll share your personal data with third parties.
The journey you booked: In order to complete your reservation, we transfer relevant reservation details to the journey you have booked. This may include your name, contact details, payment details and any preferences you specified when you made your booking. If you have a query about your reservation, we may contact the Operator to handle your request. Unless payment is made during the book process via the app, we will forward credentials for further handling. In cases of reservation-related disputes, we may provide the Operator with information about the reservation process as needed. This may include a copy of your reservation confirmation as proof that a reservation was actually made.
Third-party service providers: We may use service providers to process your personal data on our behalf. This processing is for several purposes, including marketing campaigns. Third-party service providers are bound by confidentiality clauses and are not allowed to use your personal data for other purposes.
Payment providers and other financial institutions: When a chargeback is requested for your reservation by either you or by the holder of the credit card used to make your reservation, we may need to share certain reservation details with the payment service provider and the relevant financial institution to handle the chargeback. This may also include a copy of your reservation confirmation or the IP address used to make your reservation. We may furthermore share information with relevant financial institutions, if we consider it strictly necessary for fraud detection and prevention purposes.
Competent authorities: We disclose personal data to law enforcement insofar as it is required by law or is strictly necessary for the prevention, detection or prosecution of criminal acts and fraud. We may need to further disclose personal data to competent authorities to protect and defend our rights or properties, or the rights and properties of our business partners.
Business partners: We work with many business partners and Operators. Some of these business partners distribute or advertise our services, as well as help our other business partners distribute and advertise their own services. This may mean that their services are integrated into our Platform, they have been enabled to show you a customized advertisement, or the Meep Platform services are integrated in their websites and/or apps.
When you make a reservation on one of our business partners’ platforms, certain personal data that you give them will be forwarded to us. If customer service is provided by the business partner, Meep will share details relevant to your reservation with the business partners (as and when needed) in order to provide you with efficient support.
When you make a reservation on a Operators’ website, please also take the time to read their privacy policies if you wish to understand how these Operators may process your personal data. When we offer you other mobility services, your information may be shared with the offering business partners to handle your order. For fraud detection and prevention purposes and as strictly necessary, we may also exchange information about our users with business partners.
Other Cases of Sharing Information.
We may share your information with third-parties in the following situations:
• While negotiating or in relation to a change of corporate control in Meep;
• If a government authority requests information and we believe disclosure is required in order to comply with laws;
• With law enforcement officials, government authorities, or third parties if we think doing so is necessary to protect the rights, property, or safety of the Meep community, Meep, or the public;
• To comply with a legal requirement or process, including but not limited to, civil and criminal subpoenas, court orders or other compulsory disclosures.
• If you signed up for a promotion with another User’s referral or promotion code, with your referrer to let them know about your redemption of or qualification for the promotion;
• With our insurance partners to help determine and provide relevant coverage in the event of an incident;
• To provide information about the use of the Meep Platform to potential business partners in aggregated or de-identified form that can’t reasonably be used to identify you; and
• Whenever you consent to the sharing.
Your Sharing Choices
Email Subscriptions. You can always unsubscribe from our commercial or promotional emails but we will still send you transactional and relational emails about your account use of the Meep Platform.
Push Notifications. You can opt out of receiving push notifications through your device settings. Please note that opting out of receiving push notifications may impact negatively your experience of the Meep Platform.
Profile Information. While your name will always be shared with Operators and Third-Party Providers, you can delete any additional information that you added to your Profile at any time if you don’t want Operators and the Meep team to see it.
Location Information. While you can prevent your device from sharing location information at any time through your device’s operating system settings, users’ location is core to the Meep Platform and without it we can’t provide our services to you.
Social Media Friends and Followers. You can control whether to enable or disable social media friends and followers feature through your profile settings.
Intellectual Property Rights
Unless stated otherwise, the software required for our services or available at or used by the Meep Platform and the intellectual property rights (including the copyrights) of the contents and information of and material on our Platform are owned by FOSTERING MOBILITY, S.L.
Meep exclusively retains ownership of all rights, title and interest in and to the Platform on which the service is made available and you are not entitled to copy, scrape, link to, publish, promote, market, integrate, utilize, combine or otherwise use the content or our brand without our express written permission. To the extent that you would use or combine our content or would otherwise own any intellectual property rights in the Meep Platform or any content or guest reviews, you hereby assign, transfer and set over all such intellectual property rights to Meep. Any unlawful use or any of the aforementioned actions or behavior will constitute a material infringement of our intellectual property rights.
With respect to your use of the Meep Platform and your participation in the Services, you agree that you will not:
• impersonate any person or entity;
• stalk, threaten, or otherwise harass any person, or carry any weapons;
• violate any law, statute, rule, permit, ordinance or regulation;
• interfere with or disrupt the Services or the Meep Platform or the servers or networks connected to the Meep Platform;
• post Information or interact on the Meep Platform or Services in a manner which is false, inaccurate, misleading (directly or by omission or failure to update information), defamatory, libelous, abusive, obscene, profane, offensive, sexually oriented, threatening, harassing, or illegal;
• use the Meep Platform in any way that infringes any third party’s rights, including but not limited to: intellectual property rights, copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;
• post, email or otherwise transmit any malicious code, files or programs designed to interrupt, damage, destroy or limit the functionality of any computer software or hardware or telecommunications equipment or surreptitiously intercept or expropriate any system, data or personal information;
• forge headers or otherwise manipulate identifiers in order to disguise the origin of any information transmitted through the Meep Platform;
• “frame” or “mirror” any part of the Meep Platform, without our prior written authorization or use meta tags or code or other devices containing any reference to us in order to direct any person to any other web site for any purpose; or
• modify, adapt, translate, reverse engineer, decipher, decompile or otherwise disassemble any portion of the Meep Platform or any software used on or for the Meep Platform;
• rent, lease, lend, sell, redistribute, license or sublicense the Meep Platform or access to any portion of the Meep Platform;
• use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, scrape, “data mine”, or in any way reproduce or circumvent the navigational structure or presentation of the Meep Platform or its contents;
• link directly or indirectly to any other web sites;
• transfer or sell your User account, password and/or identification to any other party
• discriminate against or harass anyone on the basis of race, national origin, religion, gender, gender identity, physical or mental disability, medical condition, marital status, age or sexual orientation, or
• cause any third party to engage in the restricted activities above.
You will defend, indemnify, and hold Meep including our affiliates, subsidiaries, parents, successors and assigns, and each of our respective officers, directors, employees, agents, or shareholders harmless from any claims, actions, suits, losses, costs, liabilities and expenses (including reasonable legal representation fees) relating to or arising out of your use of the Meep Platform and participation in the Services, including: (1) your breach of this Agreement or the documents it incorporates by reference; (2) your violation of any law or the rights of a third party, including, without limitation, Operators, other motorists, and pedestrians, as a result of your own interaction with such third party; (3) any allegation that any materials that you submit to us or transmit through the Meep Platform or to us infringe or otherwise violate the copyright, trademark, trade secret or other intellectual property or other rights of any third party; (4) your ownership, use or operation of a motor vehicle or passenger vehicle, and/or (5) any other activities in connection with the Services. This indemnity shall be applicable without regard to the negligence of any party, including any indemnified person.
Modification to the Agreement
In the event Meep modifies the terms and conditions of this Agreement, such modifications shall be binding on you only upon your acceptance of the modified Agreement. Meep reserves the right to modify any information referenced in the hyperlinks from this Agreement from time to time, and such modifications shall become effective upon posting. Continued use of the Meep Platform or Services after any such changes shall constitute your consent to such changes.
The Meep Platform services are provided “as is” and “as available.” FOSTERING MOBILITY, S.L. disclaims all representations and warranties, express, implied, or statutory, not expressly set out in these terms, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement. In addition, we make no guarantee regarding the reliability, timeliness, quality, suitability, or availability of any services requested through the use of the app, or that the services will be uninterrupted or error-free. Meep does not guarantee the quality, suitability, safety or ability of third party providers. The End users agree that the entire risk arising out of their use of the services, and any service in connection therewith, remains solely with the End users, to the maximum extent permitted under applicable law.
By uploading any content (texts, images or videos) onto our system you certify, warrant and agree that you own the copyright to the uploaded content and that you agree that we may use the uploaded content on the Meep Platform, and in promotional materials and publications to Meep’s solely discretion. However, by providing the content to Meep, you grant Meep a worldwide, perpetual, royalty-free license with the right of sublicense, to use, copy or create derivative works, sell for commercial purposes and otherwise exploit in any manner such user content without further notice and without the requirement of payment to any entity. Meep does not own or endorse the content that is uploaded by its users.
Limitation of Liability
Meep shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, lost data, including lost profits, personal injury, or property damage related to, in connection with, or otherwise resulting from any use of the Operators’ services, even if Meep has been advised of the possibility of such damages.
Meep shall not be liable for any damages, liability or losses arising out of: (i) the End users’ use of or reliance on the services or their inability to access or use the services; or (ii) any transaction or relationship between the End users and the Operator, even if Meep has been advised of the possibility of such damages.
The limitations in this section do not implicate the limitation liability or alter users’ rights as a consumer that cannot be excluded under applicable law.
Term and Termination
This Agreement is effective upon your creation of a User account. This Agreement may be terminated: a) by User, without cause, upon seven (7) days’ prior written notice to Meep; or b) by either Party immediately, without notice, upon the other Party’s material breach of this Agreement, including but not limited to any breach of Restricted Activities of this Agreement. In addition, Meep may terminate this Agreement or deactivate your User account immediately in the event: (1) you no longer qualify to provide Services under applicable law, rule, permit, ordinance or regulation; (2) you fall below cancellation threshold; (3) Meep has the good faith belief that such action is necessary to protect the safety of the Meep community or third parties, provided that in the event of a deactivation pursuant to (1)-(3) above, you will be given notice of the potential or actual deactivation and an opportunity to attempt to cure the issue to Meep’s reasonable satisfaction prior to Meep permanently terminating the Agreement.
For all other breaches of this Agreement, you will be provided notice and an opportunity to cure the breach. If the breach is cured in a timely manner and to Meep’s satisfaction, this Agreement will not be permanently terminated. Sections 2, 6, 7 (with respect to the license), 11-12, 14-19, and 21 shall survive any termination or expiration of this Agreement.
To the extent permitted by law, these terms and conditions and the provision of our services shall be governed by and construed in accordance with Spanish law and any dispute arising out of these general terms and conditions and our services shall exclusively be submitted to the competent courts in Madrid, Spain.
The original Spanish version of these terms and conditions may have been translated into other languages. The translated version is a courtesy and you cannot derive any rights from the translated version. In the event of a dispute about the contents or interpretation of these terms and conditions or inconsistency or discrepancy between the Spanish version and any other language version of these terms and conditions, the Spanish language version to the extent permitted by law shall apply, prevail and be conclusive. The Spanish version is available on our Platform (by selecting the Spanish language) or shall be sent to you upon your written request.
If any provision of these terms and conditions is or becomes invalid, unenforceable or non-binding, you shall remain bound by all other provisions hereof. In such event, such invalid provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and you will at least agree to accept a similar effect as the invalid, unenforceable or non-binding provision, given the contents and purpose of these terms and conditions.
